TERMS OF SERVICE

1. Introduction and Agreement

These Terms of Service ("Terms") constitute a legally binding agreement between you and House And Land Packages Pty Ltd (ABN 92 631 641 408) ("HALP"). By using our websites, platforms or services you agree to be bound by these Terms.

For Advertisers, these Terms also include the Listing Agreement, which is incorporated by reference. In the event of any inconsistency regarding listing specifics, the Listing Agreement prevails.

These Terms apply to www.halp.com.au, www.boutiquedevelopments.com.au, associated mobile applications, and related websites in our network.

By using our services you acknowledge you have read and understood these Terms, agree to be bound, are at least 18, and have authority to enter into this agreement. We may modify these Terms at any time; continued use constitutes acceptance.

2. Description of Services

HALP operates specialised property discovery and business directory platforms — house and land listings, off-the-plan information, new developments, school-zone integration, calculators, mortgage broker connections, and business directory services (freemium model). HALP is an information and advertising platform — not a real estate agent, developer, builder or financial advisor.

Property listing inquiries go directly to the listing agent, developer or builder. HALP does not store, read or process these inquiries. Contact Us, Join Us and Advertise With Us forms are managed by HALP per our Privacy Policy.

Services are provided "as is" and "as available". We may modify, suspend or discontinue services at any time. Infrastructure: AWS (hosting & backups), Synergywholesale (domains), Google Workspace, Stripe, Pipedrive, ActiveCampaign, Zapier.

3. User Accounts and Registration

You must provide accurate current information, be at least 18, and only create one account per person. Business accounts require valid ABN/ACN. You are responsible for account security and all activity under your account. We may suspend or terminate accounts for breach, false information, fraud, non-payment or extended inactivity.

4. User Conduct and Prohibited Activities

You agree to comply with all applicable laws, use services lawfully, provide accurate information, respect IP rights and act in good faith. Prohibited: automated systems without authorisation, interference with the platform, unauthorised access, reverse engineering, circumventing security, false or misleading content, malware, spam, phishing, impersonation, illegal activities, IP infringement, harassment, discrimination, unauthorised resale, competing use, aggregation/scraping and creating multiple accounts to bypass restrictions.

Violations may result in immediate suspension or termination, content removal, legal action and reporting to law enforcement.

5. Property Listings and Information

Listings are provided and owned by developers, builders, agents, project marketers and third-party data providers. HALP does not own, control or verify all listings. Property information may change without notice — always verify directly with the provider before making decisions. School zone data is for reference only; always verify with the school and the relevant education department.

6. Business Directory Listings

To advertise you must hold a valid ABN/ACN, be a legitimate operating business, comply with applicable laws, provide accurate information, and hold necessary licences. Listings must accurately describe services, include current contact information, use your own name and logo, comply with Australian Consumer Law and not be misleading. Free and Premium subscription tiers apply. We may remove or suspend listings for breach, credible complaints, non-payment or prohibited content.

7. Payment Terms (Advertiser Subscriptions)

Pricing is as displayed on our website, at checkout or in the applicable Listing Agreement. Prices are in AUD and displayed exclusive of GST unless stated. Payments are processed via Stripe (PCI-DSS Level 1). Subscriptions auto-renew unless cancelled. No refunds for voluntary cancellations; pro-rata refunds for technical issues preventing service access, processed within 14 business days. Payment failures may result in suspension after 7 days and listing removal after 14 days.

8. Intellectual Property Rights

All content and materials are owned by HALP or licensed to us — including "HALP", "House And Land Packages" and "Boutique Developments" marks, website design, software, text, graphics, images, video, data compilations and databases. You are granted a limited, non-exclusive, non-transferable, revocable licence to access and use our platforms for personal, non-commercial purposes. You may not reproduce, distribute, modify or commercially use our content without permission.

For user-generated content, you retain ownership and grant us a worldwide royalty-free licence to use, reproduce, modify and display your content. Copyright complaints: legal@halp.com.au.

9. Disclaimers and Limitations

HALP does not provide financial, legal, tax, real-estate or investment advice. Calculators provide estimates only. HALP is not licensed to provide valuations or represent buyers or sellers. HALP facilitates connections but does not control third-party conduct and is not party to your contracts with third parties. Data may contain errors or be outdated. We do not guarantee uninterrupted or error-free service.

10. Limitation of Liability

To the maximum extent permitted by law, HALP is not liable for loss of profits, revenue, data, business opportunities, cost of substitute services, or any indirect, consequential, incidental, special or punitive damages. Where liability cannot be excluded, our total liability is limited to $100 AUD for free services, or for paid services the lesser of $1,000 AUD or the amount you paid in the prior 12 months. Nothing excludes rights under the Australian Consumer Law. You indemnify HALP from claims arising from your breach of these Terms, violation of law, use of our services, submitted content, or interactions with users or third parties.

11. Dispute Resolution

Before legal action, contact legal@halp.com.au and allow 30 days for informal resolution. Governed by New South Wales law with exclusive jurisdiction of NSW courts. Optional arbitration in Sydney under ADRA rules. Class actions waived to the extent permitted by law.

17.2 Property Listing Inquiry Flow

Property listing inquiries are sent directly to the listing agent/developer. HALP does not store, read or process these inquiries. The advertiser is responsible for your information and their privacy policy governs its use.

17.3 Platform Inquiry Forms

Contact Us, Join Us and Advertise With Us forms are collected and stored by HALP in Pipedrive, ActiveCampaign and Google Drive; our Privacy Policy governs this data.

17.5 Advertiser Obligations

Advertisers must handle inquiries in accordance with privacy laws, maintain their own privacy policy, use information only for legitimate business purposes, not spam prospects and comply with Australian Consumer Law.

12. General Provisions

These Terms and our Privacy Policy constitute the entire agreement. If any provision is invalid the rest continues in effect. No waiver by non-enforcement. You may not assign without our consent; we may assign in a merger or sale of assets. No third-party rights unless stated. 13. Special Terms for Specific Services

Mortgage calculators provide estimates only, not pre-approvals. School zone data is for research only — always verify with the education department and school. Enrollment is not guaranteed by living in a zone. Property alerts are subject to your preferences and are opt-out at any time. HALP may receive referral fees from home loan brokers.

Excluded to the maximum extent permitted by law; capped at $100 AUD (free) or the lesser of $1,000 AUD or the amount paid in the prior 12 months (paid). ACL rights not excluded.

Q: What laws govern these Terms and how are disputes resolved?

New South Wales law, exclusive NSW jurisdiction. Informal resolution first (30 days), then optional arbitration in Sydney under ADRA rules. Class actions waived.

Q: Can HALP change these Terms?

Yes. We update the Last Updated date, notify registered users and prominently display material changes. Continued use is acceptance.
